Italy Recognises Same-Sex Mothers as legal parents

In a historic decision, Italy’s Constitutional Court has ruled that same-sex female couples who undergo IVF abroad can both be legally recognised as parents – even if one is not the biological mother.

The court found that denying recognition to the non-biological mother violates the constitutional principles of equality and personal identity, and undermines the child’s right to care, education, and emotional continuity from both parents.

However, this ruling only applies in cases where IVF was carried out outside Italy, as medically assisted reproduction for same-sex couples remains prohibited under Italian law.
